Urgent! More than 50,000 US trademarks are at risk of invalidation, with reasons and solutions

This order is a further supplement to the preliminary sanctions order issued against S Company in September 2022. S Company can respond before December 11, 2023. Most of the behaviors described in the 2022 preliminary sanctions order occurred mainly in 2020 and 2021, but existing evidence shows that the company still engaged in improper behaviors until 2022. Therefore, compared with last year's documents, this time's Trademark Office documents have added a lot of new trademarks, including trademarks applied for from 2013 to January 19, 2023.

In addition, Company S’s response to the 2022 order was not convincing and failed to resolve the issue; this time, the United States Patent and Trademark Office (USPTO) also provided additional evidence to prove that the company deliberately violated the rules of the United States Patent and Trademark Office (USPTO) and provided false information.

1. Self-examination of trademarks

Check whether your trademark is in the command file. If not, no action is required. If it is in the command file, refer to the following method.

2. Cancel the filing

A successfully registered trademark may not be approved in the 5th or 6th year. Once the document takes effect, the status of the trademark in question will be updated on the website. Then, it is only a matter of time before the store brand registration on the cross-border platform is cancelled. In order not to affect the store, it is recommended to cancel the registration in time.

3. Re-apply for a trademark

If the trademark in question is very important, we recommend that you redesign the trademark with the same name and apply for it. Please note: when reapplying for a trademark, make sure to use the same applicant and keep the same category.

The re-application of the trademark this time must strictly follow the requirements of the US Trademark Office and provide true and valid information; after registration, the record will be filed

If the trademark in question is not important, you can choose to abandon the trademark and rebuild the brand.
