Register your trademark in the United States as early as possible! USPTO plans to adjust trademark fees in October

On June 19, 2020, the United States Patent and Trademark Office (USPTO) published a notice of proposed rulemaking (NPRM). The notice shows that the United States Patent and Trademark Office (USPTO) intends to adjust or increase certain trademark fees in October. The specific adjustments/increases are as follows.






USPTO proposes to adjust the following fees

1. Application
2. Oaths under Articles 8 and 71
3. Petition to the Director
4. Opposition, Appeal and Trial Proceedings before the Trademark Trial and Appeal Board

The USPTO proposes to add the following new fees



1. Submit a second or subsequent request for an extension to file an appeal brief
2. Oral hearing
3. Protest letter
4. Request for reconsideration more than 3 months after the issuance of the review opinion
5. Deletion of goods, services and/or classifications after filing an affidavit under Section 8 or 71

Petition Fees



A new fee for filing a protest letter has been added to clarify the cost of processing such requests and to address some frivolous applications.


Request for reconsideration



1. The purpose of this fee increase is to encourage applicants to respond to office actions more promptly.

2. If you submit an application for reconsideration within three months after the issuance of the examination opinion, no fees will be incurred.

Trademark applicants and owners can expect progress at the USPTO in a number of areas, including: streamlining the examination of trademark applications , issuing high-quality trademarks, improving business efficiencies, improving the customer experience, enhancing the operation of the Trademark Review and Adjudication Board, optimizing the quality and efficiency of information technology to improve business operations, and ensuring financial sustainability to facilitate efficient operations.


The USPTO estimates that the proposed trademark fee changes could take effect as early as October 2020. In addition to the proposed fee increase, the difficulty of US trademark registration is increasing and the review will become more stringent. There are only two months left, so seize the opportunity to register early!
