Recently, a large number of Amazon sellers have encountered the crisis of "brand invalidation" - due to failure to complete the "5-6 year oath" of trademark in time , the trademark was officially declared invalid! After the brand registration was revoked, the account protection function was invalid, copycat sales were rampant, and sales plummeted, which can be called a series of critical hits!

What is the “5-6 Year Pledge”?
Simply put, in the 5th or 6th year after the registration of a U.S. trademark, a "Statement of Use + Evidence of Use" must be submitted to the Trademark Office to prove that the trademark is still in actual use.
✅Submit on time : The trademark is successfully renewed and the brand protection is as solid as Mount Tai.
❌Missed the deadline : The trademark will be invalidated directly, and the Amazon brand registration will be invalidated simultaneously!
Trademarks registered in 2019-2020 are currently in the "declaration window period"! If you fail to submit your application within the deadline, your trademark protection will be revoked and copycats can infringe your rights at will!
Consequences of overdue payment:
1. The brand registration is removed, and the rights and interests such as A+ pages and brand advertising are lost;
2. Products are copied and even counter-sued for infringement;
3. Link weight decreases, and sales plummet;
4. It takes half a year to re-register a trademark, and the loss is irreversible!
Key deadlines:
  • Normal submission period : 5-6 years from the registration date (official fee US$225)

How to renew the American Standard

Method 1: Submit a statement of use + evidence of use, official fee is US$225

You must submit a signed affidavit that the registered trademark is still in use, detailing the use of the trademark after registration, and provide evidence of the registered trademark in use, such as real product photos with the trademark, sales links with brand name and other information, etc.



Method 2: Submit a statement of use + evidence of use + an irrefutable sworn statement, with a total official fee of US$425

This form of heightened trademark protection can be chosen provided that the legal requirements are met, such as the trademark being registered in the principal register and being in continuous use in commerce for at least five years.

Submitting a sworn declaration of incontestability can strengthen trademark protection and prevent others from filing a cancellation motion for the registered trademark on the grounds of lack of distinctiveness or trademark conflict.


Documents required for submitting renewal declaration

1. Affidavit: A signed affidavit of continued use of the registered mark detailing the use of the mark after registration.

2. Evidence of use (images)

  • Authentic product images with trademarks printed on them.

  • Real photos of products and product packaging.

  • Packaging, tags, and labels printed with information such as the trademark name, product name, product description, and price.

  • A sales link with the brand name, shopping cart, launch date, USD price, and product information description.

3. Other materials: If the registered name or address is changed, relevant change certification materials must be provided.

4. Notes on providing evidence:

  • The goods/services shown in the evidence of use must be the selected sub-items, and the evidence of use must be in English only, and no Chinese characters are allowed;

  • The trademark on the evidence of use must be clear and consistent with the logo applied for registration;

  • Evidence of use must include real product photos. Do not provide forged photoshopped evidence of use photos.

  • The evidence of use provided must be able to be purchased normally in the United States;

  • If you cannot provide evidence for some sub-categories, it is recommended that you delete them when submitting the affidavit. If you are reviewed, you will need to pay a $250 official fee. (One category per time)


Note: In addition to the United States, countries or regions such as the Philippines, Argentina, Cambodia, Mozambique, and Puerto Rico also require a declaration of use in the 5th or 6th year after trademark registration. Sellers are requested to pay attention to this as soon as possible!
